1. Who we are

This website, 247expatinsurance.com (the "Website"), is owned and operated by Neil Peter Osborne, an individual insurance distributor established in Spain, trading as 247 Expat Insurance.

  • Registered address: C. Alcalde Clemente García, 19, 5, 30169 San Ginés, Murcia, Spain
  • NIE: Y0339267P
  • DGSFP registration: C0031Y0339267P (Dirección General de Seguros y Fondos de Pensiones)
  • Email: info@247expatinsurance.com

Throughout these terms, "we", "us" and "our" refer to Neil Peter Osborne trading as 247 Expat Insurance. "You" and "your" refer to any person who visits the Website or engages our services.

2. Scope & acceptance

These terms and conditions (the "Terms") govern your access to and use of the Website and any enquiry, quote or policy-placement service we provide through it. By using the Website or requesting a quote, you confirm that you have read, understood and accepted these Terms.

If you do not accept these Terms, you must stop using the Website.

3. Our role as insurance distributor

We operate as an insurance distributor within the meaning of Royal Decree-Law 3/2020 of 4 February, which transposes the EU Insurance Distribution Directive (IDD), and Law 20/2015 (LOSSEAR) on the regulation, supervision and solvency of insurance undertakings.

This means:

  • We distribute insurance products on behalf of registered Spanish insurers — including Caser (part of the Helvetia Group) as our principal insurance partner. Other DGSFP-registered Spanish insurers may also be used where appropriate for the client's needs.
  • We act as a mediator between the client and the insurer, not as a party to the insurance contract.
  • Our registration and legal status can be verified with the DGSFP at www.dgsfp.mineco.gob.es.

4. Information provided on the website

The Website provides general information about insurance products — including health, car, home, travel, funeral, pet and reverse-mortgage cover — for English-speaking residents, expats, second-home owners, retirees, families and visa applicants in Spain.

We make reasonable efforts to keep the content accurate and up-to-date, but:

  • Descriptions of products, benefits, copayments, networks and exclusions are a summary. The binding policy documents are the Conditions (General, Particular and Special) issued by the relevant insurer at the point of contracting.
  • Prices and discounts shown are indicative and may change without notice.
  • Third-party information (regulations, healthcare networks, government procedures) is included for context and may change independently of us.

5. Quotes & price validity

Any quote we provide is indicative and subject to:

  • Confirmation of the information you supply, including age, residence, medical history (for health products), vehicle details (for car products), property details (for home products) and any other underwriting factors.
  • Acceptance of your application by the relevant insurer.
  • Application of any waiting periods, exclusions or loadings the insurer may apply based on underwriting.

Unless otherwise stated in writing, a quote is valid for 30 days from the date it is issued. After that period the price may be re-quoted at current rates.

5.1 Indicative "from" prices

The "from" prices displayed on this Website are indicative only and are not binding quotes, contractual offers or guaranteed premiums. They represent the lowest available starting price for that product under the most favourable underwriting circumstances and are provided solely as a general guide to help you compare products.

Your actual premium will be calculated individually by the relevant insurer and will depend on a number of factors including, but not limited to:

  • Your age at the date of application.
  • Your primary place of residence in Spain — pricing varies by province and municipality.
  • For health products: your declared health status and any pre-existing medical conditions.
  • For car products: vehicle make, model, year, value, usage and your driving history.
  • For home products: location, build, value, security features and any unoccupied periods.
  • The plan, coverage level and optional add-ons selected.
  • The number of people, vehicles or properties to be covered.
  • Any underwriting decisions made by the insurer, which are final and at their sole discretion.

Please note: 247 Expat Insurance accepts no liability for any difference between an indicative "from" price displayed on this Website and the final premium confirmed by the insurer following full underwriting. Always request a personalised quote before making any financial decision.

6. Applying for a policy

To apply for a policy through us, you must:

  • Be at least 18 years old (or apply as the legal guardian of a dependant).
  • Be a legal resident of Spain or, in the case of pre-residency or visa-application products, intend to become one. Certain products are available to applicants without a NIE at the quote stage.
  • Provide accurate identity, contact and underwriting information.
  • Accept the insurer's underwriting decision, which may include loading, exclusion or decline.

The contract of insurance is entered into between you and the insurer, not between you and us. We facilitate and administer the application but are not a party to the policy.

7. Duty of disclosure

Under Article 10 of Spanish Insurance Contract Law (Ley 50/1980), you have a legal duty to answer truthfully and completely all questions we or the insurer put to you regarding your circumstances. For health insurance this includes pre-existing conditions, past surgeries, current medication, pregnancy status and any diagnosed illness. For car insurance this includes accident history, driving record, and the use and storage of the vehicle. For home insurance this includes the use, occupancy and security of the property.

Important: Providing inaccurate, incomplete or misleading information may allow the insurer to reduce benefits, refuse a claim, or rescind the policy. If in doubt, disclose.

8. No advice & suitability

We provide information, quotes and distribution services. We do not provide regulated financial, legal, tax or medical advice. Any general guidance we share regarding plan features, copayments, deductibles or add-ons reflects the characteristics of the available products and not a personal recommendation tailored to your individual circumstances.

Before you contract, we will supply the Insurance Product Information Document (IPID) and the contractual conditions so you can decide whether the product meets your needs and demands. You are responsible for reading them before accepting the policy.

9. Commissions & remuneration

We are remunerated by commissions paid by the insurers whose products we distribute, included in the premium you pay. You do not pay us a separate fee for our distribution services. On request, we will provide more information about the nature and basis of the commission we receive in relation to your policy.

10. Premium payment

Premiums are paid directly to the relevant insurer by the payment method you authorise at the time of contracting (typically direct debit from a Spanish bank account, or an accepted credit/debit card, including international cards on certain products). Payment frequency, cancellation for non-payment and reinstatement are governed by the insurer's policy conditions and Spanish insurance law.

11. Cancellation & cooling-off

For distance contracts, you generally have a 14-day cooling-off period from the later of (a) the date you enter into the contract or (b) the date you receive the contractual documentation, during which you may withdraw without penalty (Article 10 of Law 22/2007 on distance marketing of financial services to consumers). Thereafter, cancellation is governed by the insurer's policy conditions and applicable law.

To cancel, contact us or the insurer in writing using the details in the policy schedule.

12. Conflicts of interest

We may distribute the products of more than one insurer across different product lines. Where we have a preferred or principal relationship with a particular insurer (such as Caser for certain product lines), this is disclosed in our Legal Notice and acknowledged here. We maintain written procedures to identify and prevent conflicts of interest from adversely affecting clients. If a conflict cannot be managed, we will disclose it to you before contracting so you can make an informed decision.

13. Complaints & dispute resolution

If you are dissatisfied with our service or a product sold through us, you may raise a complaint:

  • In the first instance with us, in writing to info@247expatinsurance.com. We aim to acknowledge within 5 working days and respond substantively within 2 months.
  • With the insurer's Customer Service Department (Servicio de Atención al Cliente) as indicated in your policy schedule.
  • With the insurer's Customer Ombudsman (Defensor del Cliente), where one has been appointed.
  • With the Spanish insurance regulator, the Complaints Service of the DGSFP, once the insurer's internal process has been exhausted or two months have elapsed without a reply: www.dgsfp.mineco.gob.es.

14. Intellectual property

All content on this Website — including but not limited to text, articles, guides, layout, design, graphics, icons, logos, photographs, illustrations, images, videos, audio and source code — is the intellectual property of Neil Peter Osborne trading as 247 Expat Insurance, or is used under licence from the respective rights holders. Third-party trademarks (including the Caser and Helvetia logos and brand names) remain the exclusive property of their respective owners and are used on this Website solely to identify the products we distribute.

  • Modify, adapt or create derivative works from any content, layout, design or code on the Website.
  • Frame or embed the Website, or any page, section or content from it, within another website, application, browser extension or any other digital environment — including via <iframe>, <frameset>, object embeds or any equivalent technology.
  • Mirror the Website or any part of it on any server, CDN or other hosting environment.
  • Scrape, crawl or extract content, pricing data, plan information or any other material using automated tools, bots, spiders, scripts, browser extensions or similar means, whether for commercial or non-commercial purposes.
  • Use our content in training datasets for artificial intelligence models, machine-learning systems or any automated processing system without prior written agreement.
  • Deep-link directly to specific pages or assets in a way that bypasses our homepage or misrepresents the source of the content.

14.4 Consequences of breach

Any unauthorised use of the Website or its content may constitute an infringement of our intellectual property rights and/or a breach of these Terms. We reserve the right to seek all available remedies, including injunctive relief and damages. Infringement may also result in civil and/or criminal liability under Spanish and EU law, including the Spanish Intellectual Property Act (Real Decreto Legislativo 1/1996) and applicable EU Directives on copyright and related rights.

15. Acceptable use

When using the Website you agree not to:

  • Submit false, misleading or fraudulent information.
  • Attempt to gain unauthorised access to any part of the Website, its servers or connected systems.
  • Introduce viruses, trojans or any malicious code.
  • Use automated means (scrapers, bots) to harvest content or pricing.
  • Use the Website in a way that breaches Spanish or EU law.

16. Liability

To the fullest extent permitted by law:

  • We provide the Website on an "as is" basis and do not guarantee it will be uninterrupted, error-free or free from harmful components.
  • We are not liable for any loss or damage arising from your reliance on general information on the Website. Always check the insurer's contractual documentation before contracting.
  • Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, or for fraud.
  • Liability arising from our insurance-distribution activity is covered in accordance with applicable Spanish insurance-distribution legislation (see our Legal Notice for details).

17. Third-party links

The Website may link to third-party sites, including the DGSFP, the insurers we work with, and government portals. We do not control and are not responsible for the content, accuracy or privacy practices of those sites. Following external links is at your own risk.

18. Changes to these terms

We may update these Terms from time to time to reflect changes in law, regulation, products or our practices. The current version is always the one published on this page, with the "Last updated" date shown above. Continued use of the Website after changes are published constitutes acceptance of the updated Terms.

19. Governing law & jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the use of the Website are governed by Spanish law.

Subject to any mandatory consumer-protection rule granting you the right to bring proceedings in the courts of your place of residence, the parties submit to the exclusive jurisdiction of the Courts and Tribunals of Murcia, Spain.
